union government to issue ordinance to facilitate payment of salaries to newly elected bihar mlas - press note

President’s rule was imposed in the State of Bihar on March 7, 2005, placing the Legislative Assembly under suspended animation. Under Section 3 of the Bihar Legislature (Members’ Salaries, Allowances and Pension) Act, 1960, the Members are not entitled to receive their salaries and allowances unless they subscribe to an oath or affirmation referred to in Article 188 of the Constitution. As the Assembly was put under suspended animation, prior to the members subscribing to an oath or affirmation as above, they are ineligible to receive their salaries and allowances.

With a view to facilitating the newly elected members to draw their salaries and allowances, the Union Government has initiated steps for issuing a proclamation under Article 356 for revoking suspension of Article 195 of the Constitution, thereby paving the way for issue of an Ordinance to amend the afore stated provisions of the Bihar Legislators (Members’ Salaries, Allowances and Pension) Act, 1960.
