The Supreme Court, in Writ Petition (Civil) No. 930 of 1990 Indira Sawhney versus Union of India and Others, held that reservation for SC/ST/OBCs made under Article 16(4) of the Constitution, may be called vertical reservation and the reservation made under Article 16 (1) such as reservation for physically handicapped persons and ex-servicemen as horizontal reservation.
Horizontal reservation cuts across vertical reservation and the person selected against these reservations has to be placed in the appropriate category, such as, general / SC/ST/OBC.
As explained above, the system of horizontal reservation does not deprives ex-servicemen of the benefit of reservation.
This information was given by the Defence Minister Shri Pranab Mukherjee in a written reply to Dr. Karan Singh in Rajya Sabha today.
