Shri Manoj Jain, Addl. Chief Metropolitan Magistrate, Delhi
today convicted Shri Sanjay Bhatia, an Officer of Indian Police
Service (Haryana Cadre) under section 420 IPC. Shri Sanjay
Bhatia has been held guilty for getting appointed to the Indian
Police Service on the basis of a false Scheduled Caste Certificate.
The case against Shri Sanjay Bhatia was registered on 30.10.86
by CBI on the basis of source information. It was alleged
that Shri Sanjay Bhatia who belonged to Bhatia-Rajput Community
had entered into criminal conspiracy with certain other persons
and obtained a false Scheduled Caste Certificate as an ‘Adi
Dharmi’ from the office of Dy. Commissioner, Delhi.
On the basis of the false Scheduled Caste Certificate, Shri
Sanjay Bhatia appeared in the Civil Services Examination for
the year 1984 as a Scheduled caste candidate and got selected
for appointment in the Central Information Service. He again
appeared in the Civil Services Examination the next year as
a Scheduled Caste candidate and was selected and appointed
in the Indian Police Service which he joined in 1986. He was
allotted Haryana Cadre.
During investigation, it was disclosed that prior to 1984,
Shri Sanjay Bhatia had already appeared in Civil Services
Examination during the years 1979, 1980 & 1982 as a General
category candidate but had failed to get selected. Thereafter,
he fraudulently obtained a false Scheduled Caste certificate
on the basis of which he was finally selected for the Indian
Police Service.
The Chargesheet in this case was filed on 26.2.87 against
Shri Sanjay Bhatia, his father Shri Kasturi Lal Bhatia, IAS
(Retd.), his brother Shri Ravi Bhatia and three other persons
for offences punishable under 120-B, 420, 467 and 471 IPC
and substantive offences thereof, Shri Kasturi Lal Bhatia
expired during the trial.
After 17 years of trial, the court pronounced its judgement
today convicting Shri Sanjay Bhatia and held him guilty u/s
420 IPC. His co-accused, however, have been acquitted. The
court has fixed 12.7.05 for pronouncing sentence in this case.
Sh. Bhatia is still serving in his cadre as Superintendent
of Police.
