The Central Bureau of Investigation has invoked the stringent
provisions of Maharashtra Control of Organized Crime Act (MCOCA)
as extended to NCT, Delhi against Sansar Chand and Sudesh
Kumar, both infamous for wildlife crime. Intimation to this
effect has been given by the investigating agency to the competent
court. This is the first instance of the application of the
stringent provisions of MCOCA in the investigation of a wildlife
crime in the country.
It may be noted that CBI had taken the custody remand of
Sansar Chand in connection with the Kamla Nagar Police Station
Case of wild life crime which was transferred to CBI from
the Wild Life Department of Delhi. After expiry of the custody
period of 10 days, Sansar Chand was today produced before
the ACMM, Tis Hazari Court, Shri Manoj Jain, who granted further
CBI custody of Sansar Chand upto 14.7.2005. During the course
of investigation of the wildlife cases which CBI is currently
investigating, the ingestigating agency has come across evidence
indicating the organised nature of the wildlife crimes committed
by Sansar Chand and his crime syndicates. These evidences
have been corroborated by revelation of Sansar Chand during
the course of his custodial interrogation.
After obtaining several leads and analysis of evidence,
CBI was of the view that the investigation of the crimes committed
by Sansar Chand can be effectively tackled under the provisions
of MCOCA. The Agency also felt that under the provisions of
the Act, speedy trial will be possible to meet the ends of
justice.
