The Election Commission had sent a team of officers comprising Shri Rajesh Aggarwal, Principal Secretary-cum-Director in the Commission and Shri Afzal Amanullah, Special Observer of the Commission for Haryana to enquire into the alleged violations of the Model Code of Conduct in the matter of appointments in the police department and in the matter of the special supplement issued by the Indian Express dated 1.1.2005 which gave details of the achievements of the Government of Haryana, and other related matters.
2. The officers have submitted their detailed enquiry reports on various issues. The reports bring out the following findings: -
i. Large-scale recruitments in the police at the level of Sub-Inspectors and Constables have been done even after the coming into operation of the Model Code of Conduct.
ii. The concerned Superintendents of Police and Commandants of Haryana Industrial Security Force and Haryana Armed Police have taken the first joining of police personnel much after the Model Code of Conduct came into operation and without following laid down procedures.
iii. At many places, interviews for recruitments in the police have been held and results announced much after the Model Code of Conduct came into force.
iv. Additionally, in the police department at other levels like Cooks, Sweepers, Barbers and Drivers, recruitments have been made in violation of the Model Code of Conduct and without going through the procedures under the rules.
v. Hundreds of Junior Basic Teachers have been allowed to join various places of posting after the Model Code of Conduct came into force.
vi. Without any written notice and without any agenda, a Cabinet meeting was held at the residence of the Chief Minister, Haryana at Chandigarh on 17.12.2004 at 10.30 PM wherein the creation of a new district was approved. This violated the Model Code of Conduct which had come into effect in the afternoon of 17.12.2004.
vii. The special supplement of Indian Express was printed on 1.1.2005 which was against the spirit of the Model Code of Conduct and against the concept of providing a level playing field for all the political parties since the supplement detailed the achievements of the Government of Haryana with photographs of the Chief Minister and Finance Minister, etc.
viii. The Public Relation deptt. of the Haryana Government continued to give advertisements and notices of tenders, auctions, etc. which violate the Model Code of Conduct.
3. The reports submitted by the enquiry team are being examined in the Commission.
