fee waived for aay card holders in consumer courts

Complainants belonging to Below Poverty Line (BPL) holding Antyodaya Anna Yojana cards are exempted from payment of specified fee for filing cases in the District Forum of consumer courts for cases up to Rs. one lakh. Exemption of payment of fee can be availed of on production of an attested copy of Antyodaya Anna Yojana card. For complainants other than Antyodaya Anna Yojana cardholders, the fee for filing cases up to Rs. one lakh has been fixed at Rs. 100. The fee for filing complaints for cases involving Rs. one lakh and up to five lakh, Rs. 200 will be charged as fee. For cases above Rs. five lakh and up to Rs. 10 lakh, the fee is Rs. 400 while cases involving above Rs. 10 lakh and up to Rs. 20 lakh it will be Rs. 500 in District Forum.

In State Commission the fee for filing cases involving more than Rs. 20 lakh and up to Rs. 50 lakh has been fixed as Rs. 2000 and those for above Rs. 50 lakh and up to Rs. one crore it is Rs. 4000. The National Commission, which handles cases above Rs. one crore will charge a fee of Rs. 5000.

The above fee structure has come into force by the Consumer Protection (Second Amendment) Rules, 2005. The amount of fee so received will be credited into the Consumer Welfare Fund of the respective States. In cases where such fund is not established into the Receipt Account of the State Governments and in the case of the National Commission, the amount would be credited to the Consumer Welfare Fund of the Central Government.
