The Ministry of Railways has issued orders constituting a One-man High Level Committee to examine the arbitration system on the Indian Railways under the Chairmanship of Shri Justice Bhubaneswar Prasad a retired judge of the Patna High Court.
The Committee will study the reasons for growing number of arbitration cases relating to Railways in various fora including Departmental Arbitration Tribunal, subordinate courts, High Courts and the Supreme Court.
It will suggest ways and means to reduce the number of arbitration cases, including changes necessary in the extant contractual provisions, and suggest most appropriate alternative dispute resolution mechanism to minimize delay in settling arbitration cases.
The Committee will also suggest measures for attracting the best legal counsels to work for the Railways to deal with the arbitration cases effectively. It will also work out steps for in-house arbitration settlement mechanism.
The Committee will advise possibilities of use of International Centre for Alternative Disputes Resolution (ICADR) in cases where Railways are a party, and any other further measures for effective handling of arbitration cases.
Headquartered at Patna, the Committee will have a tenure of one year.
