The Additional District Judge, Lucknow convicted two police
constables, Mahant Singh and Fauzdar Singh, both of Police
Station Kaundhiara, Distt. Allahabad (U.P.) for murdering
a private person Sh. Om Prakash. Both the accused were sentenced
to life imprisonment with a total fine of Rs. 3,000/- each.
The case was registered on 12.2.97 by the CBI on the directions
of Allahabad High Court.
CBI investigation revealed that deceased Om Prakash was
running a watch repair shop and working as a tailor in a village
Pidi in Distt. Allahabad. He was married and having a daughter.
He was in love with a girl, Rekha Srivastava of adjoining
village Sondhia. Both Om Prakash and Rekha ran away from their
house on 14.12.94. A case was registered by the girl’s
father at Police Station Kaundhiara against the boy for abducting
the girl and investigation was taken up by Sub-Inspector,
P.N.Singh. During the course of investigation, SI P.N.Singh
learnt that Om Prakash and Rekha were residing at Wadi, Distt.
Nagpur. He alongwith two constable Fauzdar Singh Kushwaha
and Mahant Singh, Dr. Narendra Kumar Srivastava (brother of
girl), Rajendra Prasad Srivastav (maternal uncle of girl),
Rajendra Pal Singh @ Govind Singh and two lady Constables
reached Wadi Distt. on 31.12.94. They reached Maihar Distt.
Satna (MP) on the morning of 1.1.95 and P.N.Singh sent Km.
Rekha along with the two lady constables for darshan in Maihar
Devi temple.
Subsequently, P.N.Singh along with other accused persons
eliminated Om Prakash after strangulating him to death in
Janata Toilet near Maihar Devi temple on 1.1.95. After leaving
the dead body, the accused persons fled from Maihar and reached
Kaundaria. The dead body of Om Prakash was recovered by Maihar
Police and remained as unidentified. The case was registered
by them and final report was filed in this case as the case
could not be detected.
CBI investigation established that the unidentified body
was that of Om Prakash. However, accused Sub-Inspector, P.N.Singh
concealed the fact of arrest & subsequent murder of deceased
at Maihar and also furnished false information in this regard
in the Allahabad High Court. He also submitted a chargesheet
in absentia against deceased Om Prakash after completing the
process against him knowing fully well that he was already
murdered. After thorough investigation, CBI filed a chargesheet
against P.N.Singh (SI), Fauzdar Singh Kushwaha (Constable),
Mahant Singh (Constable), Dr. Narendra Kumar Srivastava, Shiv
Baran Singh @ Banne Singh, Rajendra Pal Singh @ Govind Singh
and Rajendra Prasad Srivastava in the court of Addl. Distt.
Judge, Lucknow on 16.5.98. Along with chargesheet, 45 witnesses
and 19 documents were cited by the CBI. During the course
of trial proceeding, accused P.N.Singh committed suicide and
accused Narendra Kumar Srivastava died in a road accident.
