It has been a clear and consistent policy of the Election Commission that the bye elections shall be held at the earliest possible opportunity in order to ensure that no segment of the Indian people are left unrepresented for unnecessary length of time. There are four clear vacancies in the Lok Sabha and three clear vacancies in various State Legislative Assemblies as of date. These are vacancies, which are not subject to any election petition or appeal pending in any court and where the remaining tenure of the concerned Lok Sabha / State Legislative Assembly is more than one year. The details of these vacancies are as follows: -

The schedule for holding elections from 20-Trivandrum PC in Kerala and 8-Mumbai North-West PC and 3-Malvan AC in Maharashtra and 15- Pattan AC in Jammu and Kashmir will be announced separately. Bye-election from 20-Trivandrum PC cannot be held now as local bodies elections are scheduled to be held in the State of Kerala in September, 2005. Bye-elections from 8-Mumbai North West PC and 3-Malvan AC cannot be held as normal life has not resumed after floods in the State of Maharashtra. Since, electoral rolls in the State of Jammu and Kashmir w.r.t. 1.1.2005 are not ready as yet the Bye-election from 15- Pattan AC will also be announced later.
ELECTRONIC VOTING MACHINES
The Commission has decided to use EVMs in these bye-elections in all the polling stations. Adequate numbers of EVMs have been made available to the states and all steps have been taken to ensure that the poll is conducted smoothly with the help of these machines.
IDENTIFICATION OF VOTERS
In consonance with the past practice, the Commission has decided that compulsory identification of voters will be made in the aforementioned bye-elections. In order to ensure that no voter is deprived of his/her franchise, if his/her name figures in the Electoral Rolls, separate instructions are being issued to allow additional documents of identification of voters in the said Lok Sabha /Assembly Constituencies.
MODEL CODE OF CONDUCT
The Model Code of Conduct comes into force with immediate effect i.e., 17th August, 2005. It will apply to the whole of the district in which the whole or a part of any Assembly or Lok Sabha Constituency going for Bye-election is included. The Model Code of Conduct shall be applicable to all Political Parties, the concerned State Governments and Union Government in respect to states in which bye-elections are being held.
