The Minister for Law and Justice, Shri H. R. Bhardwaj in a reply to the question from Smt. Jaya Bachchan said in Rajya Sabha today that the Government has not received any proposal from the Chief Justice of India for appointment of Judges in the Supreme Court against the existing vacancies or the vacancies occurring till December, 2005.
The Minister further stated that there are three vacancies already existing on 01.08.2005 and four more vacancies are occurring till December, 2005 as four more Judges are superannuating.
The entire process of initiation of the proposal for appointment of Judges in the Supreme Court rests with the Chief Justice of India after the Supreme Court Judgment dated 6th October, 1993 in the case of Supreme Court Advocates-on-Record & Another Vs. Union of India and read with the Advisory Opinion of October 28, 1998.
