important clarification

The attention of the Ministry of Defence has been drawn to the news item “Arms Procurement Clean Chit Given to Fernandes.” The Ministry would like to clarify that this does not represent the correct position.

The Counter Affidavit filed on behalf of the Union of India is in two parts. The first part dealt with procedures. The first part clarified that the modified procedures were not in violation of the Financial Rules of Government or the Defence Procurement Procedures in 1992.

This however did not conclude the issues. The second and more important issue specifically dealt with whether the Rules were in fact followed in relation to the nature and actual delivery of items. On the second issue, the affidavit makes the following significant points:

That the CAG has made valid points which had been duly noted and action is being taken on it. In fact, it is categorically stated that the Ministry has continued to make efforts to address issues raised in the CAG.
The affidavit points out, that even after the expiry of the term of the Tehelka Commission, a reference has been made to the CBI and the CBI is actively examining the transactions mentioned in the Tehelka tapes.
Apart from this, the CVC recommendations with regard to the involvement of agents and middlemen and other allegations made are still being looked into. Individual contracts which had been given are being examined closely.
The affidavit concludes by saying that there were cases pertaining to T-90S Tanks, Armoured Recovery Vehicles and Up-Gunning of 130 mm - 46 Field Guns of 155 mm caliber have also been referred to the CBI. Thus, five cases have been presently referred to the CBI and are being actively investigated.
There was no question of giving a clean chit to any person, much less Shri George Fernandes. The affidavit does not even refer to or mention any person, much less Shri George Femandes. Therefore the inference which is sought to be drawn that "a clean chit has been given to Shri George Fernandes is unjustified and totally unwarranted.
