extradition treaty with nepal

The Cabinet gave its approval for the signing and ratification of Extradition Treaty between India and Nepal.


The Treaty would provide an improved and more effective legal framework for extradition of fugitive offenders including those who may be wanted in respect of economic offences. It would work as a deterrent for criminals and would help minimize criminal activities with international ramifications.


The 1953 Extradition Treaty, which is currently operative between India and Nepal, lacks provisions on several basic issues, including, treatment of nationals of the requested State and of a third State, method of determining extraditable offences, obligation to extradite or prosecute, obligations under international conventions, reconsideration of an extradition request once refused in certain cases, and exceptions to the political offence defence plea by a fugitive.
