The Union Cabinet today gave its approval for the amendment of the Administrative Tribunals Act, 1985 to provide for abolition of the Central Administrative Tribunals and State Administrative Tribunals. This decision will enable the Central Government to consider the requests of State Governments for abolition of State Administrative Tribunals and will also enable the Government to consider the question of abolition of Central Administrative Tribunal as and when considered necessary.
There is no provision either in Article 323A of the Constitution or in the Administrative Tribunals Act, 1985 which allows an Administrative Tribunal to be abolished. This is anomalous, as any institution, however important, may outlive its usefulness over time. A reasonable exit route is thus called for.
A Bill to amend the Administrative Tribunals Act, 1985 will be introduced in the current session of Parliament.
