Mumbai: For once, the prime accused in the multi-crore stamp scam, Abdul Karim Telgi remained seated even as the Director General of Maharashtra Police P S Pasricha stood in front of the judge. Pasricha was deposing before the special CBI court here in connection with the sanction given by him to prosecute two police officers in the scam.
Pasricha had sanctioned action under the Prevention of Corruption Act against Assistant Police Inspectors K S Parmar and A Sonwalkar, who have been charged with abetting Telgi in the scam.
Both Parmar and Sonwalkar had challenged Pasricha's decision to sanction proceedings against them on the ground that he did not read the concerned documents carefully before authorising the sanction.
"Pasricha was examined as the sanctioning authority. In his deposition before the court, he said that he had studied all the copies of the case before according sanction for action against the two officers," special public prosecutor Pradip Gharat told reporters.
Pasricha had come to the conclusion that an offence was made out against these officers, therefore he granted the sanction, Gharat said.
The offence was registered on the basis of stamps supplied to theTelco company, Gharat said. The then controller of stamps Radheshyam Mopalwar had published an advertisement in newspapers asking those who had purchased stamps from Telgi to come forward. In response to that appeal, these companies have come forward, he said.
In this case, previous chargesheets have been filed before the court by the CID and later by CBI. When CBI filed the chargesheet, the material placed before the court disclosed that prima facie, an offence under the Prevention of Corruption Act was made out against the two officers, Gharat said.
The CBI said the sanction of competent authority was required. To enable the court to take cognisance of the offence, the papers were sent to Pasricha as the sanctioning authority.
After the sanction was received from Pascricha, the chargesheet was filed, Gharat said.
Pasricha submitted to the court today that he was satisfied that there was ground for sanctioning prosecution of the two officers, after studying the papers sent to him.
