Yukta Mookhey refused interim relief

The Bombay High Court on Monday turned down the request for interim relief to former Miss World Yukta Mookhey in the matter of possession of a rented flat in Lokhandwala complex in Andheri. The owners of this flat had offered this flat as a collateral to Bank Of India, and the bank now wants .the possession of the flat as the loan for which flat was offered as security has not been paid.

Mookhey had approached the High Court, seeking to restrain the Bank from evicting her, saying that as a lawful tenant she has the right to occupy it.

She had also sought interim directions to bank not to evict her until the case is decided, but High Court refused to give her interim relief. She has been given six weeks' time to approach the Supreme Court. Mookhey had rented the flat from Sanjivanee Properties Limited some years ago. Sanjivanee properties had earlier stood a guarantor or the loan obtained by another company, Harmoni Fabric Fashion Pvt Ltd, and this flat was mortgaged to Bank of India as a collateral.

Since Harmonic defaulted repayment of loan, the Bank wants to take the possession of the flat. Mookhey had earlier approached metropolitan magistrate's court when bank sent notice in this regard, but the court as well as debt recovery appelate tribunal did not grant her relief, so she filed appeal in the High Court.
