The Supreme Court of India has upheld the expulsion of 11 members of Parliament in the Cash for Questions scam. The 5-judge Constitutional bench headed by Chief Justice of India Y K Sabharwal found no merit in upturning the Parliament's decision and dismissed the petition in a 4-1 judgement.
Justice R V Ravindran expressing dissent said the guidelines for such expulsion were laid down in sections 101 and 105(3) of the Constitution. The Parliament had expelled 11 members 10 of whom belonged to Rajya Sabha and 1 to Lok Sabha on December 23, 2005. Raja Rampal, a Bahujan Samaj Party member had challenged the expulsion along with other expelled members of parliament.
