Plastic bags Banned

Mumbai: The governor of Maharashtra S M Krishna has signed the ordinance aimed at banning plastic bags below 50 microns and size 8 by 12 inches. The decision h to ban plastic below 50 microns was taken by the State Cabinet on February 7 and the same was sent to the Governor for his signature.

The ordinance bans packing of foodstuff in recycled plastic and lays down disposal norms for polyethylene, acrylic, nylon and thermacol. It also provides for trying all offences under the code of criminal procedure.

The authorities get more teeth to implement the ban.

The local municipal corporations would be the implementing authority. All offences under the ordinance shall be tried by a judicial magistrate and provisions of Sections 262 to 265 of the Code of Criminal Procedure 1973 will be applied to such trials. The defaulters would be levied

Rs 5,000 for the first offence, Rs 10,000 for the second and for the third time it would be imprisonment for three months and a fine of Rs 25,000.

Also, in case a manufacturing company does not comply with rules, the person in "charge including a director, manager, secretary or any other party to the offence would be held responsible. Authorities would also have the power to enter any premises to examine records or conduct searches that may furnish evidence of an offence punishable under, this ordinance.
