The MCOCA court on Wednesday deferred the hearing in the gutka case as Mumbai police commissioner A N Roy has not yet accorded sanction to prosecute gutka barons Jagdish Joshi and Manikchand Dhariwal for their alleged links with the underworld.
Early this month, the CBI had reportedly sent a letter to Roy asking him to give sanction for prosecution of the two gutka kings under Maharashtra Control of Organised Crime Act (MCOCA).
The two gutka barons are facing allegations of exporting gutka pouch manufacturing machinery to Pakistan via Dubai to help underworld don Dawood Ibrahim in setting up gutka business in the neighbouring country. The CBI has already chargesheeted four accused Anees Ibrahim, Jumbo, Panchariya and Farooq Mansoori. Both jumbo and Panchariya had been detained under MCOCA for helping Anees Ibhrahim to start up gutka business in Dubai. While Panchariya has been granted bail by the Bombay High Court, Jumbo is still in custody.
Panchariya happens to be a relative of Sunil Joshi, who was previously working for Rasihklal Dhariwal. Jumbo and Panchariya had allegedly exported the gutka-manufacturing machine to Dubai via Pakistan. Jumbo and Panchariya were arrested last year.
On February 5, the MCOCA court had directed the CBI to file a report on the case with the commissioner's sanction as for applying MCOCA it is necessary to have sanction from high level Police.
If Commissioner of Police accord the sanction, than Sunil and Rasiklal would be tried under MCOCA.
During the last hearing, the CBI had sought some time for filing the report. But when the case comes up on Wednesday, the Central probe agency again sought some time saying that Commissioner's sanction was still awaited. The MCOCA court has now given 15 days' time to CBI to file the report. The next hearing would be on March 9.
