Nayak gets no Daya in SC

New Delhi: It took the Apex Court just three minutes flat on Friday to dismiss a petition by encounter specialist Daya Nayak, closing all avenues for him except surrendering to court in Mumbai. Daya is likely to surrender on Saturday, sources said. Nayak is facing arrest in a case of amassing wealth disproportionate to his known sources of income by misusing his official position.

Nayak had engaged India's topmost jurist Fali Nariman to defend him in the Supreme Court, surprising many in the legal fraternity. Legal circles were full of talk about the fees Daya must have been made to pay up. However, all of it was guesswork.

However, all were unanimous that the name Nariman itself creates a sense of awe. All the same, they were astonished that a police sub-inspector could persuade an expensive lawyer like Nariman to take up his case.

In the case that was over within a flash, the State of Maharashtra was represented by Mr. R Adsule.

A bench comprising Justice Arijit Pasayat and Justice S H Kapadia refused to interfere with the Bombay High court order dated February 8 which had directed Nayak to surrender before the police within a week.

The apex court, however, ruled that when the petitioner files an application for regular bail after surrendering, the same would be heard and decided immediately on merits.
