Mumbai: In an interesting case, the Special Judge, CBI cases, Mumbai, Shri J.D. Salvi convicted a Tax Assistant in the Income tax Office, Circle No.1 (6) Aayakar Bhawan, Mumbai, Shri Jai Kumar Daswani for demanding and accepting a bribe of Rs.3,000/- from the complainant for settling her income tax refund claim, despite the most important panch witness, Shri M.S.Mishra, turning hostile and not supporting the prosecution case during trial. However, the witness admitted the prosecution story during his cross-examination by the Senior Public Prosecutor of CBI. The other witnesses supported the prosecution. On the basis of the evidence, the Special Judge sentenced Daswani to undergo one year Rigorous Imprisonment and imposed a fine of Rs.5,000/-. The Special Judge also took cognizance of the hostility of the panch witness and issued a notice of perjury to him. Mishra, the hostile witness is a Tally Clerk, with the Mumbai Port Trust, Mumbai.
CBI had registered a case against Daswani on the basis of a complaint from the complainant that he had demanded Rs.3,000/- as bribe for settling her income tax refund claims of Rs.33,200/- and Rs.10,990/- for the assessment years, 1995-96 and 1996-97 respectively. On the basis of the complaint, a trap was laid and Daswani was caught red-handed while accepting the bribe amount from the complainant.
After investigation, CBI, Anti-Corruption Branch, Mumbai filed a charge sheet in the court of Special Judge, CBI, Mumbai against the accused for offences under sections 7 and 13(1)(d) of Prevention of Corruption Act, 1988.
